1. Agreement to Terms
By downloading, installing, or using IncidentApp ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
The App is owned and operated by Appalanche Inc. ("Company," "we," "us," or "our"), a technology company that builds tools for incident documentation and safety.
2. Description of Service
IncidentApp is a mobile application designed to help users document accidents and incidents. The App provides tools for:
- Capturing photos, videos, and audio recordings at the scene of an incident
- Scanning and storing documents such as driver's licenses, insurance cards, and vehicle registrations using optical character recognition (OCR)
- Recording witness and passenger information
- Generating comprehensive incident reports
- Timestamping and preserving evidence integrity
The App is currently offered on a free basis. We may introduce optional paid features or subscription tiers in the future. If we do, we will notify you and obtain your consent before charging any fees.
3. Not a Legal Service
All content provided within the App, including but not limited to guides, checklists, informational screens, and documentation tools, is for general informational and educational purposes only and should not be construed as legal advice.
Laws and regulations vary by jurisdiction, and the information in this App may not reflect the current legal requirements applicable to your situation. For advice regarding your specific circumstances, you should consult with a licensed attorney in your jurisdiction.
Appalanche Inc. is a technology company, not a law firm. Using the App does not create an attorney-client relationship with Appalanche Inc. or any other party.
4. Eligibility
You must be at least 13 years old to use this App. By using the App, you represent and warrant that you are at least 13 years of age. If you are under 18, you represent that you have your parent or guardian's permission to use this App.
5. User Responsibilities
When using the App, you agree to:
- Provide accurate and truthful information
- Use the App only for lawful purposes
- Not use the App to harass, threaten, or harm others
- Not upload false, misleading, or fraudulent content
- Not attempt to reverse engineer, decompile, or hack the App
- Not use the App to manufacture or fabricate false evidence
- Comply with all applicable local, state, and federal laws
6. Your Data & Evidence
Ownership
You retain full ownership of all content you create or upload using the App, including photos, videos, audio recordings, scanned documents, and incident reports. Your data belongs to you.
How We Use Your Data
By using the App, you grant Appalanche Inc. a limited, non-exclusive license to process your content solely as necessary to provide the App's services. This includes:
- Processing photos and documents through OCR to extract text
- Generating incident reports from your collected data
- Timestamping evidence for integrity verification
Local Storage
Your incident data is stored locally on your device. If you delete the App, locally stored data will be removed from your device. Any data previously uploaded to cloud services will not be affected by deleting the App.
7. AI & Automated Processing
The App uses artificial intelligence and automated systems to:
- Extract text from scanned documents (OCR)
- Parse and organize document data (driver's licenses, insurance cards, vehicle registrations)
- Analyze photos and videos for quality and completeness
- Generate incident reports and narrative summaries
- Suggest relevant questions based on your incident type
How We Protect Your Data During AI Processing
Your privacy is built into our AI pipeline. Before any personal or sensitive information is sent to AI services for processing, it is masked and tokenized — meaning personally identifiable details (such as names, addresses, and policy numbers) are replaced with anonymized placeholders.
Third-Party AI Services
The App uses Google Cloud services for optical character recognition (OCR) and related processing. We maintain a Business Associate Agreement (BAA) with Google to ensure compliance with applicable privacy and security requirements, including HIPAA standards.
Accuracy
AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying all extracted data and generated reports before relying on them.
8. Evidence Integrity
The App offers optional evidence integrity features, including timestamping and cryptographic verification. When you use these features:
- A cryptographic hash (digital fingerprint) of your evidence is created
- The hash can be used to verify that evidence has not been altered
- The actual content of your files is NOT stored in any verification record — only the hash
9. Privacy & Medical Information
Your privacy is important to us. Our full Privacy Policy, available separately, describes in detail how we collect, use, and protect your personal information.
The App may collect information about injuries and medical symptoms as part of incident documentation. This information is stored locally on your device and is only shared if you explicitly choose to share it.
10. SMS & Text Messaging
IncidentApp uses SMS text messaging solely for account verification purposes (one-time passcodes / OTP). By providing your phone number and requesting a verification code, you consent to receive these messages.
- Message frequency: SMS messages are sent only when you request a verification code. No recurring or marketing messages are sent.
- Opt-out: Reply STOP to any message to opt out of receiving SMS messages. Note that opting out may prevent you from verifying your account.
- Help: Reply HELP to any message for assistance, or contact us at connect@appalanche.ai or 213-326-8000.
- Message and data rates may apply. Your carrier's standard messaging and data rates apply to all SMS messages sent and received.
- Supported carriers: Service is available on most major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
- Privacy: Your phone number is used only for account verification and is handled in accordance with our Privacy Policy. We do not share your phone number with third parties for marketing purposes.

11. Intellectual Property
The App, including its design, features, code, algorithms, user interface, and content, is owned by Appalanche Inc. and is protected by copyright, trademark, patent, and other intellectual property laws. All rights are reserved.
As stated in Section 6, you retain full ownership of any content you create or upload using the App.
12. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPALANCHE INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.
Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the past twelve (12) months, if any.
14. Indemnification
You agree to indemnify and hold harmless Appalanche Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
15. Termination
We reserve the right to terminate or suspend your access at any time. You may stop using the App by deleting it from your device. Sections 3, 6, 11, 12, 13, 14, and 17 shall survive termination.
16. Changes to Terms
We may modify these Terms at any time. We will notify you of significant changes through the App. Your continued use constitutes acceptance of the modified Terms.
17. Governing Law & Disputes
These Terms shall be governed by the laws of the State of California. Any disputes shall be resolved in the state or federal courts located in Los Angeles County, California.
