By downloading, installing, or using IncidentApp ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
The App is owned and operated by Appalanche Inc. ("Company," "we," "us," or "our"), a technology company that builds tools for incident documentation and safety.
IncidentApp is a mobile application designed to help users document accidents and incidents. The App provides tools for:
The App is currently offered on a free basis. We may introduce optional paid features or subscription tiers in the future. If we do, we will notify you and obtain your consent before charging any fees.
All content provided within the App, including but not limited to guides, checklists, informational screens, and documentation tools, is for general informational and educational purposes only and should not be construed as legal advice.
Laws and regulations vary by jurisdiction, and the information in this App may not reflect the current legal requirements applicable to your situation. For advice regarding your specific circumstances, you should consult with a licensed attorney in your jurisdiction.
Appalanche Inc. is a technology company, not a law firm. Using the App does not create an attorney-client relationship with Appalanche Inc. or any other party.
You must be at least 13 years old to use this App. By using the App, you represent and warrant that you are at least 13 years of age. If you are under 18, you represent that you have your parent or guardian's permission to use this App.
When using the App, you agree to:
You retain full ownership of all content you create or upload using the App, including photos, videos, audio recordings, scanned documents, and incident reports. Your data belongs to you.
By using the App, you grant Appalanche Inc. a limited, non-exclusive license to process your content solely as necessary to provide the App's services. This includes:
Your incident data is stored locally on your device. If you delete the App, locally stored data will be removed from your device. Any data previously uploaded to cloud services will not be affected by deleting the App.
The App uses artificial intelligence and automated systems to:
Your privacy is built into our AI pipeline. Before any personal or sensitive information is sent to AI services for processing, it is masked and tokenized — meaning personally identifiable details (such as names, addresses, and policy numbers) are replaced with anonymized placeholders.
The App uses Google Cloud services for optical character recognition (OCR) and related processing. We maintain a Business Associate Agreement (BAA) with Google to ensure compliance with applicable privacy and security requirements, including HIPAA standards.
AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying all extracted data and generated reports before relying on them.
The App offers optional evidence integrity features, including timestamping and cryptographic verification. When you use these features:
Your privacy is important to us. Our full Privacy Policy, available separately, describes in detail how we collect, use, and protect your personal information.
The App may collect information about injuries and medical symptoms as part of incident documentation. This information is stored locally on your device and is only shared if you explicitly choose to share it.
IncidentApp uses SMS text messaging solely for account verification purposes (one-time passcodes / OTP). By providing your phone number and requesting a verification code, you consent to receive these messages.

The App, including its design, features, code, algorithms, user interface, and content, is owned by Appalanche Inc. and is protected by copyright, trademark, patent, and other intellectual property laws. All rights are reserved.
As stated in Section 6, you retain full ownership of any content you create or upload using the App.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPALANCHE INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.
Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the past twelve (12) months, if any.
You agree to indemnify and hold harmless Appalanche Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
We reserve the right to terminate or suspend your access at any time. You may stop using the App by deleting it from your device. Sections 3, 6, 11, 12, 13, 14, and 17 shall survive termination.
We may modify these Terms at any time. We will notify you of significant changes through the App. Your continued use constitutes acceptance of the modified Terms.
These Terms shall be governed by the laws of the State of California. Any disputes shall be resolved in the state or federal courts located in Los Angeles County, California.
